John Marshall, The Trilogy Cases, and the Trail of Tears
During the latter half of his career, the Marshall Court heard a trilogy of cases concerning Indian land jurisdiction in Georgia: Johnson v. McIntosh (1823), Cherokee Nation v. Georgia (1831), and Worcester v. Georgia (1832). How did John Marshall view indigenous sovereignty, and did his decision-making and relationship with the US Presidency lead to the forced removal of 16,000 Cherokee from Georgia in a tragic event known as the Trail of Tears?
